Terms of Service

Effective Date: January 19, 2026

These Terms of Service ("Terms") govern your access to and use of MobileVibe, including the MobileVibe website, web app, desktop software, and related services (collectively, the "Services").

MobileVibe is operated by Brainpowertools LLC, a Delaware limited liability company ("Company," "we," "us," or "our").

By accessing or using the Services, you agree to be bound by these Terms.

1. Eligibility

  • You must be at least 18 years old to use the Services.
  • The Services are intended for adult users.
  • By using MobileVibe, you represent that you meet these requirements.

2. Early Access Status

MobileVibe is currently provided as an early access product (alpha or beta).

You understand and agree that:

  • The Services may contain bugs or errors
  • Features may change, break, or be removed
  • The Services may cause interruptions, data loss, or unexpected behavior
  • The Services are provided "as is" and "as available."

3. Account Registration and Authentication

  • You must create an account using a supported authentication provider (currently Google).
  • You are responsible for maintaining the security of your account and credentials.
  • You may not share your account or access credentials with others.
  • You are responsible for all activity that occurs under your account.

4. Your Responsibilities

You acknowledge and agree that:

You are solely responsible for:

  • Your devices
  • Your files and data
  • Any commands or actions executed through the Services

MobileVibe enables remote interaction with machines you control.

You must not use the Services to access machines, accounts, or data that you do not own or have authorization to use.

We are not responsible for:

  • File deletion or modification
  • Command execution
  • Misconfiguration
  • Loss of data
  • Actions taken through third-party tools (including VS Code, extensions, or AI systems)

5. Acceptable Use

You agree not to:

  • Use the Services for any illegal or unlawful purpose
  • Access or attempt to access systems you do not own or control
  • Interfere with or disrupt the Services or infrastructure
  • Circumvent security or authentication mechanisms
  • Reverse engineer, decompile, or misuse the Services

We reserve the right to suspend or terminate access, with or without notice, for violations of these Terms or misuse of the Services.

6. AI and Automation Features

MobileVibe does not autonomously act on your behalf.

  • All actions are initiated by you
  • Any future AI-assisted features:
    • May produce incorrect, incomplete, or misleading output
    • Are provided without guarantees of accuracy or suitability

You are responsible for reviewing and approving any actions or outputs.

7. Fees and Future Billing

MobileVibe may currently be offered at no cost.

Some features may become paid or subscription-based in the future.

If fees are introduced:

  • Unpaid accounts may be suspended
  • Access may be restricted until payment is resolved

We will provide notice before introducing paid features.

8. Suspension and Termination

We may:

  • Suspend or terminate your access for violations of these Terms
  • Disable access immediately in cases of abuse or security risk

Upon termination:

  • Your access to the Services will stop immediately
  • Account data will be retained for up to 30 days to allow for account recovery or dispute resolution
  • After 30 days, we will delete your personal data in accordance with our Privacy Policy
  • Some information may be retained longer if required by law or for legitimate business purposes (e.g., fraud prevention)

9. Intellectual Property

  • The Services and all related software, branding, and content are owned by Brainpowertools LLC or its licensors
  • You are granted a limited, non-exclusive, revocable right to use the Services
  • You retain ownership of your own content and data.

10. Feedback

If you provide feedback, suggestions, ideas, or recommendations regarding the Services ("Feedback"), you agree that:

  • Such Feedback becomes the property of Brainpowertools LLC
  • We may use, modify, and incorporate Feedback into the Services without compensation or attribution
  • You waive any rights you may have in such Feedback

This allows us to improve the Services based on user input during the alpha and beyond.

11. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE."

WE DISCLAIM ALL WARRANTIES, INCLUDING:

  • MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT

WE DO NOT GUARANTEE THAT THE SERVICES WILL BE ERROR-FREE OR UNINTERRUPTED.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR SPECIAL DAMAGES
  • OUR TOTAL LIABILITY WILL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SERVICES IN THE PRIOR 12 MONTHS, OR $100, WHICHEVER IS GREATER

13. Indemnification

You agree to indemnify, defend, and hold harmless Brainpowertools LLC and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Services
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Any content or data you transmit through the Services

14. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles.

Any disputes will be resolved in the state or federal courts located in Delaware.

15. Changes to These Terms

We may update these Terms from time to time.

If we make material changes, we will update the effective date and provide notice through the Services where appropriate.
